real estate problems in West Springfield,MA
Respected sir/madam,
Open letter to the Mayor of the West Springfield Gregory C. Neffinger\r\nMarch 23, 2012\r\n\r\nDear Mr. Neffinger\r\n\r\nAccording to our research, majority of the West Springfield real estate properties have parking problems and group of West Springfield Town Hall employees manipulating with Minimum Off – Street Parking Requirements of the West Springfield Zoning Ordinance Section 9 Additional Land Use Regulations Table 9-1 and handicapped accessible parking space rules – how to apply or do not apply the same rules and regulations to different cases which is the discrimination.\r\n\r\nI believe that discrimination is a serious human rights violation and to fight against discrimination requires consolidated effective action (at list showing some effort) to fight violence.\r\n\r\nWe have met several times regarding 1130 – 1142 Memorial Avenue West Springfield Property problem. During the last meeting with you I provided all documentation what I got from West Springfield Authorities regarding this case which is clearly demonstrating inaccurate and discriminative information. You asked West Springfield Planning-Zoning Director Mr. R Werbiskis, to review parking issue at 1130 – 1142 Memorial Avenue West Springfield and he sent you e-mail with next information:\r\n“Building permit issued in 1986 (Permit #121) to allow for the construction of a professional office building with 8 off-street parking spaces.”\r\n\r\nThis statement is pure lie and nonsense.\r\n\r\nI’m holding in my hand the Building Permit Report # 121 for 1136 Memorial Ave. of Building Department of the West Springfield Town Hall which says:” Permit #121 was issued in 05.09.1986 (Rep: RJW), for Mr. Rettura Pasquale to erect office and Retail Building 10-26-87 Occupancy, parcel under 1130-1142 Memorial Ave.\r\n\r\nPlease, note that permit # 121 contains no information about construction of a professional office building with 8 off-street parking spaces ???\r\n\r\nRetail establishment at 1130-1142 Memorial Avenue with floor plan of 2200 s/f, according to minimum Off-Street Parking Requirements of the West Springfield Zoning Ordinance SECTION IX. ADDITIONAL LAND USE REGULATIONS Table 9-1- (One space per 200 square feet of gross floor area exclusive of basements and garages used solely for utility and storage purposes) requires to have 11 parking spots in project to get a permit to build in 1986.\r\n\r\nNext, West Springfield Planning-Zoning Director Mr. R Werbiskis states: “The following permits were issued for interior renovation: a) 1987 (Permit #173 – Tenant build out for 4 station hair salon\r\n\r\nPlease, note that the same year when building was constructed, in 1987 (permit # 173, ) tenant build out for 4 station hair salon the 1138 Memorial Ave.in the construction of a professional office building with 8 off-street parking spaces which requires 4 parking spots ???\r\n\r\nNext, West Springfield Planning-Zoning Director Mr. R Werbiskis states: “b) 1988 (Permit # 465) – Interior renovations – No plans.”\r\n\r\nPlease, note that the 1 year later, after building was constructed, in 1988 (permit # 173, ) they made interior renovations for opening “King Pizza” pizza shop in the 1140 Memorial Ave. construction of a professional office building with 8 off-street parking spaces, which requires 5 parking spots ???\r\n\r\nNext, West Springfield Planning-Zoning Director Mr. R Werbiskis states: “c) 2007 (Permit # 161) – Tenant build out for pizza shop and two vacant tenant spaces.” d) 2007 (Permit #191) - Hood system for pizza shop.\r\n\r\nPlease, note that “ Tenant build out for pizza shop and two vacant tenant spaces” statement is pure lie. In 2007 my partner and I (first generation immigrants) purchased a three unit commercial property at 1138, 1140, 1142 Memorial Avenue, West Springfield, MA. At that time, one unit was leased to the Alforno Pizza shop, while the second and third units were being leased. They made interior renovations for opening Alforno Pizza (Hood and anti-fire systems) in the 1140 Memorial Ave. in construction of a professional office building with 8 off-street parking spaces???\r\n\r\nMr. Neffinger, I see no reason to continue…It is not hard to see all nonsense…This is the game where no winners…\r\n\r\nMore than 6 month, constantly providing inaccurate and discriminative information for the trustable West Springfield Authorities is honor or shame?\r\n\r\nI emigrated from ex-USSR where treatment and consideration were mostly based on category rather than individual merit. (In other words bribe, prejudice attitude and government were in one level). I see no difference between my past and this situation.\r\n\r\nIf it’s not discrimination, please, help me name my situation...\r\n\r\nPlease, as your bright election platform and \\\"Six Point Economic Plan\\\" says, stop the game between real-estate owners and group of West Springfield Town Hall employees which demonstrating discriminative manipulation with rules and requirements.\r\n\r\nIf you need, I can provide very interesting information about other new buildings and real-estate properties in West Springfield that do not comply with current parking parameters, but they somehow continue to build and operate their businesses.\r\n\r\nPlease, clearly address your position on the parking issues or apply Minimum Off – Street Parking Requirements of the West Springfield Zoning Ordinance Section 9 Additional Land Use Regulations Table 9-1 and handicapped accessible parking space rules to all real- estate owners in West Springfield, MA as soon as possible.\r\n\r\nWith respect\r\n\r\n\r\nRasim and Alex\r\n1130-1142 Memorial Avenue property owners\r\n
