Complaint: Judge Payton is bad for Landlords and for society in general. Last year I had to evict a tenant. Prior to the court date the tenant moved out. I asked Judge Payton to amend the record to show only a request for back rent. He lied and said I could not; that I was requesting for possession and since possession was obtained prior to the court date I was not entitled to the back rents. He said I’d have to make a separate case; making it through his court as a ‘small claim’ for rent. I recently had to evict another tenant and had the exact same situation, this time it was handled in Precint 3-1, not 3-2 with Judge Payton. The tenant showed up, just as was the situation with Judge Payton, and possession was already given to me. I asked the judge to amend the file and only asked for back rent as the judgement. The judge granted it. After the request was granted I told the judge about the incident with Judge Payton and I was told that Judge Payton likes to be kind to people who have been kicked out and that what Judge Payton did was wrong and incorrect. Here’s why this is a problem for Landlords and society as a whole. Landlords make their living by renting out properties and when people don’t pay it cost money. Legislation is on the books to protect landlords. Worst yet, was that Judge Payton is not only hurting Landlords but society in general and future landlords. Why? Because bad paying tenants need to have their records flagged (judgments) so that future people and landlords can be protected. When landlords do background checks we rely on records being updated. Judge Payton is hurting this process. Shame on Judge Payton for not protecting Landlords, society in general, future landlords of these tenants who don’t pay and for not upholding to the consitution of the great state of Texas; for not being impartial and abiding by the laws on the book. If you’re a Landlord do NOT USE Judge Payton.
